Abstract

The commercial act is characterized by increasing complexity and an urgent need for adaptation due to the rapidly evolving economic and technological environment. Commercial acts, defined as those transactions for profit-making purposes, must be regulated in a way that reflects both traditional commercial practices and the new realities imposed by digitalization and globalization. The research has been based on a desk-based approach, through an exhaustive review of the existing literature, including specialized books and academic articles. The methodology included the selection and critical analysis of relevant sources. Information from various documents was collected and synthesized to build a robust theoretical framework that facilitates a detailed understanding of the topic. Significant disparities between national and international regulations were identified, which generate uncertainty and barriers to cross-border trade. Current trends, such as globalization and digitalization, are driving significant changes in commercial legislation. Lack of harmonization and regulatory complexity emerge as major challenges, while the integration of advanced technologies and international cooperation are presented as potential solutions. It is concluded that the regulation of commercial acts and their legal concept require constant adaptation to new economic and technological realities. The need for international harmonization is evident to facilitate more efficient trade and overcome legal barriers. Moving towards more flexible regulatory approaches, integrating emerging technologies into regulations, and strengthening cooperation between jurisdictions to address global challenges will allow for a more coherent and dynamic legal framework, supporting sustainable economic growth and the evolution of commercial law.
